NEWSCHANNEL 3'S DRIVE GREEN THIS SPRING CONTEST RULES Contest runs 3/5/2009 to 4/1/2009 OFFICIAL PROMOTION RULES: 1. Promotion Description. This promotion is sponsored by WTKR-TV 3, 720 Boush Street Norfolk, VA 23510 and Charles Barker Toyota, 1877 Laskin Road, Virginia Beach, VA 23454 ("Sponsor(s)"). The Contest begins on March 5, 2009 at 11pm and ends at 6:30 PM on April 1, 2009 ("Contest Period"). WTKR-TV reserves the right to extend the contest date. 2. Eligibility: Only one (1) entry per person and one (1) prize per household for the Contest. Participant(s), winner(s) and guest(s) must be legal US residents at least 18 years old as determined by WTKR-TV and reside in the Hampton Roads Designated Market Area as defined by the Nielson Company. Winners are subject to a verification process to include winner's name, address, home phone number, work/cell phone number and social security number. If a winner is disqualified, WTKR-TV reserves the right to determine an alternate winner or to not award that winner's prize at all. Employees of WTKR-TV, the Contest's participating sponsors and their advertising agencies, employees of other television or radio stations, and members of the immediate families of such persons are not eligible to participate and win. The term "immediate family" includes spouses, siblings, parents, children, grandparents and grandchildren, whether as "in-laws" or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other person residing at the same household whether or not related. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Contest is void where prohibited and is subject to all federal, state and local laws and regulations. 3. How to Enter. There are three ways to enter this promotion. During the Contest Period, viewers will be invited to watch the NewsChannel 3 at 11 PM newscast to get the keyword. (a) Acceptance On-Line: Beginning Wednesday, March 5, 2009 and continuing through Monday, March 30, 2009, viewers will use the keyword broadcast during NewsChannel 3 at 11pm to register on-line at wtkr.com. One winner will be randomly selected the following morning to receive a one hundred dollar gas card. WTKR-TV may announce prizes in addition to or other than the $100 gas card. The nightly winners will also be registered to be a finalist in the Charles Barker Toyota Prius Hybrid giveaway. (b) Acceptance by Texting: Beginning Wednesday, March 5, 2009 and continuing through Monday, March 30, 2009, viewers will use the keyword broadcast during NewsChannel 3 at 11pm to register by texting that keyword to a number broadcast along with the keyword during the newscast. One winner will be randomly selected the following morning to receive a one hundred dollar gas card. WTKR-TV may announce prizes in addition to or other than the $100 gas card. The nightly winners will also be registered to be a finalist in the Charles Barker Toyota Prius Hybrid giveaway. Each contest day, texting will begin at 11pm and continue until 9am the following day. (c) Contest Entry Form at Charles Barker Nissan: Beginning Wednesday, March 5, 2009 and continuing through Monday, March 30, 2009, viewers will have another chance to enter to win the Toyota Prius Hybrid by completing an entry form at Charles Barker Nissan using any of the keywords. On Monday, March 30, 2009 four finalists will be drawn at random from the entries received at the dealership to receive a one hundred dollar gas card. Each finalist will then be eligible for the drawing to win the Toyota Prius Hybrid. Two winners will be picked every weekday morning starting March 6, 2009 from the previous nights texting and on-line entries and continue through March 31, 2009; one texting entrant and one on-line entrant. You must enter the new keyword each night to be eligible for the next mornings drawing. The pool of entrants from which WTKR draws the daily winners is cleared every morning @ 11am. To increase your chances of being a daily winner, you are allowed to enter the nightly keyword at wtkr.com, as well as, text it to 69227. No mechanically reproduced, software-generated or other automated multiple entries are permitted. Sponsor is not responsible for lost, late, illegible, misdirected or mutilated entries, including due to transmission, technical, and/or network failures of any kind, including, without limitation, malfunctioning of any hardware or software (whether originating with sender or Sponsor(s), telephonic failures, human error, or any other error or malfunction. Entry materials that have been tampered with or altered are void. Any questions regarding the number of entries submitted by an individual shall be determined by Sponsor(s) in its/their sole discretion, and Sponsor(s) reserve(s) the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the promotion. 4. Prize(s). The thirty six (36) daily winners from the on-line and texting entries along with the four (4) randomly selected entries from Charles Barker Toyota will receive one $100 gas card and (1) entry in the grand prize drawing. A random drawing from among all finalists described in section 3(a), 3(b) and 3(c) will be conducted on or about April 1, 2009 by a WTKR-TV station representative or a Charles Barker Toyota representative. The grand prize Winner will receive the grand prize of one (1) 2009 TOYOTA PRIUS PACKAGE #2 IN BLACK STOCK #D9283. Sponsor reserves the right to substitute a prize, in which case a prize of equal or greater value will be awarded. The 2009 Toyota Prius awarded to the grand prize winner will be titled to the winner and at no time has it been titled WTKR-TV or any station representative. 5. How the Prizes are Awarded. For daily prizes – every morning after the contest begins, one on-line entrant and one texting entrant with the correct keyword will win the daily prize. For grand prize - The grand prize will be awarded via a random blind drawing out of the daily winners and finalists selected from entries at Charles Barker Toyota. The drawing will take place on Wednesday, April 1, 2009 at Charles Barker Toyota located at 1877 Laskin Road, Virginia Beach, VA 23454. Daily winners must be present to win the grand prize. 6. Odds of Winning. The odds of winning depend on the number of eligible entries received. 7. Delivery Disclaimer: WTKR disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. WTKR is not responsible for mechanical, technical, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of entries, traffic congestion on telephone lines which may limit an entrant's ability to participate in the Contest. 8. Conditions of Acceptance of Prize. Driver's license or other appropriate picture identification showing proof of age is required to claim a prize. The winner(s), and/or any other persons necessary will be required to execute and return a release and affidavit of eligibility within 10 days of prize notification, or the prize will be forfeited. A winner must take possession of his or her prize by 5:00 p.m. 4/15/2009 or the prize will be forfeited. Daily Winner(s) will be solely responsible for any and all local, state, and federal taxes, as well as license and registration fees incurred by participating in the promotion, including, but not limited to, transportation costs, gratuities and other items of an incidental nature. WTKR-TV will pay the tax, title and processing fees for the 2009 Toyota Prius Hybrid for the Grand Prize Winner. WTKR-TV will report any individual winnings over $600 (in cash or fair market value of goods or services) in a one year period to the Internal Revenue Service. Winner(s) will receive a Form 1099 from WTKR-TV if WTKR-TV reports any winnings to the Internal Revenue Service. Prize(s) may not be exchanged for cash or any other consideration. 9. Release; Publicity; Use of Personal Information: By participating in the Contest, each participant and winner waives any and all claims of liability against WTKR-TV, its employees and agents, the Contest's sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by WTKR-TV. By accepting a prize, winner consents to use of name, state of residence and likeness for advertising and promotional purposes online and in print, or in any other media worldwide in connection with the Contest, without limitation and without additional compensation worldwide, except where prohibited by law. 10. Limitation on Liability. By entering this promotion, each entrant forever discharges and releases Sponsor(s), its/their parent companies, subsidiaries, affiliates, and their respective directors, officers, employees, and agents from any and all liability, claims, causes of action, suits, and demands of any kind arising from or in connection with the promotion, including, without limitation, responsibility for property damage, loss of life, or personal injury resulting from or in connection with participating in the promotion or from or in connection with use or receipt of the prize(s), however caused. 11. Sponsor's Reservation of Rights. These official rules are subject to modification by WTKR-TV. In the event of a dispute, all decisions made by WTKR-TV are final and binding. Sponsor(s) reserve(s) the right, in its/their sole discretion, to disqualify any person who tampers with the entry process or the operation of Sponsor's/Sponsors' web site(s), or who otherwise acts in violation of these official rules. Sponsor(s) further reserve(s) the right, in its/their sole discretion, to cancel, terminate, or modify this promotion if, for any reason, the promotion is not capable of completion as planned (including, but not limited to, for the following reasons: infection by computer virus, technical corruption, force majeure, or non-authorized human intervention that compromises or affects the administration, fairness, integrity, security, or proper conduct of the promotion). 12. Miscellaneous: Each winner must submit proof of eligibility and sign WTKR's release form to claim the prize. WTKR may substitute prizes, amend the rules or discontinue the Contest at any time as announced on the Station(s). WTKR disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. 13.
