The owner of the J&L Market in Suffolk will not face charges in connection with the shooting death of a man accused of breaking into the store.
The shooting happened on June 21st after James Durden was alerted to a break-in at his story on Whaleyville Road. Durden saw Ernest Scott Roop inside the store and fired at him, killing him.
The Commonwealth's Attorney office found that store owner, James Durden, was facing "a very dangerous situation created by Roop and was legally justified in using deadly force as he genuinely believed that Roop had a firearm and that his own life was in danger."
