Massachusetts State Police confirm a mother and child at the center of an Amber Alert were located in Waverly, Virginia Wednesday afternoon. The child, three-month-old Gaebria, was unharmed, police said.

Police said Cheryl Kozaczek, 28, took her three-month-old daughter early this morning. She does not have legal custody of the child, police said.

The child’s father told the CBS affiliate in Springfield, Mass. that a court custody hearing was scheduled for today. He said the state now has temporary custody of the child.

Kozaczek was last seen leaving her home in Westfield, Mass. around 1:00 a.m. Police said she was driving a gray 2004 Toyota Tacoma pick up truck with Massachusetts plate 85ZH15.
