A Virginia soldier is charged with arson - and isn't in jail. But a judge says: Stay put.

A judge told Timothy Updike he must stay and work at Fort Story.

The decorated Army Sergeant cannot leave post for any reason or he will go straight to jail.

Suffolk investigators charged the 27-year-old with setting a string of fires in the Chuckatuck community over the past four months.

All the arsons were within walking distance of Updike's home in Suffolk.

His preliminary hearing is scheduled for July.
