UPDATE: Norfolk security guard charged with rape

UPDATE: The case against Michael Spearman will move forward. After hearing testimony from the ODU student, a judge ruled today that the case can be presented to the grand jury. The Commonwealth's Attorney withdrew two sodomy charges, but Spearman still faces the rape charge, officials say.

Norfolk, Va. - A security guard charged with sexually assaulting an ODU student is due in court today.

This past April, police charged 29-year-old Michael Spearman with rape.

They say he was a security guard at the District apartment complex near the Old Dominion University campus.

They say he was on duty when it happened.

Michael Spearman faces a rape charge, as well as two counts of forcible sodomy.

Spearman's family says it's not true.

They spoke only to NewsChannel 3 shortly after ODU police arrested him.

"What went through your mind at first?"

"It can't be true. Why would somebody say that about a person who wouldn't hurt anyone?"

The mother of Spearman's five children defended her fiance.

"He's a great person. Anybody who's ever met him, you know he's sweet, he's charming, he's giving."

"Nah, he ain't do that, that's not him. That's not his character."
