Man accused of shooting brother in Chesapeake

Chesapeake, Va. - Chesapeake police say a man shot and killed his half brother late Thursday night after the two got into a physical altercation in South Norfolk.

Around 11:20 p.m., police were called to the 2300 block of Virginia Ave.  They say Russell Newhart, 55, and his  brother 44-year-old Benjamin Novack  got into fight. That's when police say Newhart shot Novack to death.

Newhart then went to the neighbor's house to have them call police. He was later arrested. His brother died on the scene.

NewsChannel 3 learned that a lawsuit shows that Novack was in the process of suing three of his siblings over the home their mother left them on Virginia Avenue where the shooting occurred.

Charges are pending against Newhart.
