The U.S. Department of Education wants the fine against Virginia Tech to be reinstated. The school was fined $55,000 for delayed warnings during the massacre where 33 people died.
Last month, a judge dismissed the fine saying the university didn’t violate the federal law requiring schools to issue timely warnings during a threat.
The Roanoke Times reports the Education Department asked U.S. Secretary Arne Duncan to uphold the fine.
The state attorney general’s office, which is representing Virginia Tech, has until June 1 to file a response.
