Virginia Beach, Va. - Virginia Beach Treasurer John Atkinson was found not guilty for DUI this morning in a Virginia Beach courtroom.
However, Atkinson has been found guilty of refusing to take a breathalyzer test, NewsChannel 3 has learned.
The Commonwealth did not have enough evidence to show that he was intoxicated.
Atkinson says he believes he was targeted.
He was pulled over last September after leaving an Oceanfront restaurant. He said at the time that he did drink some wine, but not enough to be drunk.
He pleaded no contest to Driving Under the Influence back in 1987.
He has been Beach Treasurer since then.
